The timeline: from OpenAI to Google, an expanding legal front

On July 14, 2026, TechCrunch reported una nuova azione legale collettiva contro Google. I querelanti includono nomi di peso nell’editoria accademica e commerciale: Hachette, Cengage, Elsevier e altri editori di rilievo internazionale. L’accusa è diretta: Google avrebbe utilizzato opere protette da copyright per addestrare i propri modelli di intelligenza artificiale, senza ottenere le necessarie licenze.

Non si tratta di un caso isolato. Infatti, negli ultimi due anni il panorama del contenzioso legale attorno all’AI generativa si è densificato rapidamente. OpenAI ha affrontato cause da parte del The New York Times e di altri editori. Stability AI è stata citata da Getty Images. Analogamente, Meta e altri big tech si trovano a gestire procedimenti simili in diverse giurisdizioni. Pertanto, la causa contro Google si inserisce in un pattern strutturale, non in un episodio eccezionale.

Quello che distingue questo procedimento è la qualità dei querelanti. Elsevier, in particolare, è uno dei principali distributori di contenuti scientifici e accademici al mondo. Cengage opera nel mercato dell’editoria educativa. Hachette è tra i cinque grandi dell’editoria trade globale. Di conseguenza, il valore economico e simbolico delle opere coinvolte è considerevole.

Una lettura strategica della vicenda richiede di identificare chi guadagna e chi perde in questo scenario. Gli editori, ovviamente, puntano a ottenere compensazioni economiche e, soprattutto, a stabilire un modello di licensing per l’uso dei propri contenuti nell’AI training. In questo senso, potrebbero essere i vincitori di lungo periodo, se i tribunali daranno loro ragione.

Google, dal canto suo, ha risorse legali e finanziarie per resistere a lungo. Tuttavia, una sconfitta in giudizio potrebbe costringerla a rinegoziare l’accesso ai dati di training per Gemini e per gli altri modelli della famiglia Google AI. Di conseguenza, i costi di sviluppo e manutenzione di questi sistemi potrebbero aumentare significativamente.
